Agreement To Terms

These Terms of Service ("Terms") govern your use of creatorlayer.com and any services provided by CreatorLayer ("we," "us," or "our"). By accessing our website, submitting a form, or engaging our services, you agree to these Terms.

If you engage us under a separate signed proposal or services agreement, that document controls where it conflicts with these Terms.

Our Services

CreatorLayer provides digital marketing and production services, including:

• SEO, GEO, and AEO (search, generative, and answer engine optimization)
• Paid advertising management (Meta Ads, Google Ads)
• Video editing, graphic design, and creative production
• Web design and development
• Social media management and custom growth programs

Specific deliverables, timelines, and service levels are defined per engagement in your proposal, package description, or statement of work.

Engagements & Scope

Each engagement begins with a written scope covering deliverables, schedule, and price. Work outside the agreed scope requires written approval and may be billed separately. We will always confirm any additional cost before proceeding.

Fees & Payment

• Monthly plans are billed in advance at the start of each billing cycle.
• Yearly plans are billed in advance and include the discount stated at purchase.
• Project work typically requires a deposit before work begins, with the balance due per the agreed milestones.
• Ad spend paid to platforms (Meta, Google, etc.) is separate from our management fees and is paid by you directly unless agreed otherwise.

Invoices are due within the period stated on the invoice. We may pause work on overdue accounts after reasonable notice.

Cancellation & Refunds

• Monthly plans can be cancelled with 30 days' written notice; you retain access through the end of the paid period.
• Yearly plans can be cancelled at the annual renewal date; mid-term cancellations are credited at our discretion based on work delivered.
• Fees for work already performed and third-party costs already incurred are non-refundable.

Client Responsibilities

To deliver on schedule we need your cooperation, including:

• Timely access to required accounts, websites, and brand assets
• Prompt feedback and approvals at agreed review points
• Accurate information about your business, products, and legal requirements
• Ensuring content you supply does not infringe third-party rights

Intellectual Property

Upon full payment, you own the final deliverables we create for you — including ad creatives, designs, video edits, and website code commissioned for your project. We retain ownership of our pre-existing tools, templates, and know-how, and may showcase non-confidential work in our portfolio unless you ask us not to.

Results Disclaimer

Marketing outcomes depend on factors outside any agency's full control — including search engine algorithms, ad platform policies, market conditions, and your own pricing and product. We commit to professional, data-driven execution and transparent reporting, but we do not guarantee specific rankings, traffic levels, or revenue figures.

Limitation Of Liability

To the maximum extent permitted by law, our total liability arising from any engagement is limited to the fees you paid us for that engagement in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including lost profits or data, or for actions taken by third-party platforms (e.g. ad account suspensions or algorithm changes).

Confidentiality

Both parties agree to keep non-public business information shared during an engagement confidential and to use it only for the purposes of the engagement. Our handling of personal data is described in our Privacy Policy.

Termination

Either party may terminate an engagement for material breach if the breach is not cured within 14 days of written notice. On termination, you pay for work performed to date, and we hand over completed deliverables and account access in an orderly manner.

Changes To These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
